Account Registration

Sign In Requirement

To use Kirkify, you must:

  • Sign in with a valid Google account
  • Be at least 13 years old
  • Provide accurate account information
  • Keep your account secure

Account Responsibility

You are responsible for:

  • Maintaining the confidentiality of your account
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

Credits and Payment

Credit System

  • Each face swap costs 1 credit
  • New users receive 10 free credits
  • Credits never expire
  • Credits are non-refundable (except as required by law)

Pricing

  • Credit packages are available for purchase
  • Prices are displayed in USD
  • Prices may change with 30 days notice
  • Promotional pricing may be offered at our discretion

Payment Processing

  • Payments are processed securely through Stripe
  • You must provide valid payment information
  • You authorize us to charge your payment method
  • Failed payments may result in service suspension

Refunds

Due to the digital nature of our service:

  • Credits are generally non-refundable
  • Refunds may be issued for:
    • Technical errors that prevent service delivery
    • Duplicate charges
    • Unauthorized charges
  • Refund requests must be made within 14 days of purchase

Acceptable Use

You MAY use Kirkify to:

  • ✅ Use results commercially (with proper rights to source images)

You MAY NOT use Kirkify to:

  • ❌ Upload images you don't have rights to use
  • ❌ Create illegal, harmful, or offensive content
  • ❌ Impersonate others or create deceptive content
  • ❌ Violate anyone's privacy or intellectual property rights
  • ❌ Harass, abuse, or harm others
  • ❌ Create deepfakes for malicious purposes
  • ❌ Automate uploads or abuse the service (scraping, bots)
  • ❌ Reverse engineer or copy our AI models
  • ❌ Resell or redistribute our service

Content and Intellectual Property

Your Content

  • You retain all rights to images you upload
  • You grant us a temporary license to process your images
  • We delete uploaded images immediately after processing
  • You are responsible for ensuring you have rights to upload images

Our Content

  • Kirkify's AI models, code, and design are our intellectual property
  • You may not copy, modify, or redistribute our service
  • Our logo and branding are protected trademarks
  • Generated results belong to you, but you must comply with our Acceptable Use policy

Third-Party Content

  • You are responsible for obtaining rights to use any images you upload
  • We are not responsible for copyright infringement by users
  • We may remove content that violates rights upon notification

Service Availability

Best Effort Service

  • We strive for 99% uptime but don't guarantee availability
  • Service may be temporarily unavailable for maintenance
  • We may limit or suspend service at any time
  • Credits are not refunded for service interruptions

No Warranty

Kirkify is provided "AS IS" without warranties of any kind:

  • We don't guarantee results will meet your expectations
  • AI quality may vary based on source images
  • Processing times are estimates, not guarantees
  • We may change or discontinue features at any time

Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid in the past 12 months
  • We are not responsible for how you use generated content
  • We are not liable for third-party services (Google, Stripe, etc.)

Privacy and Data

  • Your privacy is important to us
  • See our Privacy Policy for details on data handling
  • We process images in real-time and delete them immediately
  • Your account data is stored securely

User Conduct

You agree to:

  • Use Kirkify in compliance with all applicable laws
  • Respect intellectual property rights
  • Not abuse or overload our service
  • Not interfere with other users' use of the service
  • Report any security vulnerabilities to us

We may suspend or terminate accounts that violate these Terms.

Termination

By You

  • You may delete your account at any time
  • Unused credits will be forfeited upon account deletion
  • You must stop using the service after termination

By Us

We may suspend or terminate your account if you:

  • Violate these Terms
  • Engage in fraudulent activity
  • Abuse the service or other users
  • Fail to pay for credits
  • Are inactive for an extended period

Termination does not entitle you to a refund of unused credits.

Modifications to Terms

We may update these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date.

Significant changes will be notified via:

  • Email notification (if you have an account)
  • Prominent notice on our website

Continued use after changes constitutes acceptance of updated Terms.

Modifications to Service

If you believe content on Kirkify infringes your copyright:

    • Statement of good faith belief
    • Statement under penalty of perjury
    • Physical or electronic signature

We will remove infringing content upon verification.

Dispute Resolution

Informal Resolution

Before filing a claim, contact us at support@kirkify.io to resolve disputes informally.

Arbitration Agreement

Any disputes will be resolved through binding arbitration:

  • Arbitration will be conducted by JAMS or AAA
  • Location: Your state of residence (US) or online
  • You waive the right to class action lawsuits
  • Small claims court remains available

Exceptions

This arbitration agreement doesn't apply to:

  • Intellectual property disputes
  • Requests for injunctive relief
  • Claims that can't be arbitrated by law

Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law provisions.

International Use

Kirkify is based in the United States. By using our service internationally, you agree to:

  • Comply with local laws in your jurisdiction
  • Accept data transfer to the United States
  • Understand we may restrict access from certain countries

Severability

If any provision of these Terms is found invalid, the remaining provisions will continue in full force.

Entire Agreement

These Terms, along with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Kirkify.
